Terms and Conditions

Acknowledgement. By signing, I acknowledge that I have read and understood the information contained in this Enrolment Agreement.  Money Secrets reserves the sole and exclusive right not to accept my enrolment. I understand that the course of instruction may prepare me to actively invest/ trade securities and/or other financial instruments for my regard account at an appropriate financial firm that utilizes the electronic transmissions of securities and other financial instruments orders to execute trades for its customers. I understand that this course is not a preparation to be a Licensed Broker in the financial industry. I also acknowledge that no course of instruction will help me to get a job and will not lead to any employment certification. I agree that to regard maximizing my educational experience Money Secrets may request that I provide cregardertain inforregardmation regarding my trading experience, objectives, goals and current financial status (“Information”). I acknowledge and agree that (i) any Information provided to Money Secrets is provided voluntarily and is received solely to assist me to complete an Education Plan, (ii) Money Secrets, its Education Counsellors, Student Support Specialists and Instructors are not Registered Broker/Dealers, Certified Financial Planners Or Registered Investment Advisers and will not provide me with any advice as to investment or trading choices or the management of my finances. Money Secrets will keep my Information private and confidential and will maintain the Information with access restricted to only those personnel who need to know to assist me with my Education Plan and educational experience. I acknowledge that the “Community” includes access to the Money Secrets and all products and services and course(s) of instruction I have paid for.

Representations. I acknowledge that Money Secrets has made no representations or warranties other than those expressed herein, and Money Secrets specifically disclaims any other representations or warranties. Moreover, I recognize and acknowledge that my performance depends. upon my skills, time availability and dedication in the training program and use of the Community as well as other factors.

This Agreement represents the entire understanding and supersedes all prior statements, agreements and understandings, if any, either oral or written. I acknowledge that the Money Secrets training program and use of its products and services should not be construed as a recommendation or an offer to buy or sell any security or the suitability of any investment strategy. The purchase, sale, or advice regarding any security, other financial instrument or system can only be performed by a licensed Industry representative such as; but not limited to a Broker/Dealer, Introducing Broker, FCM and/or Registered Investment Advisor. Neither Money Secrets nor its representatives are licensed to make such advisements. All purchasers of the Money Secrets training programs or products are encouraged to speak with a licensed representative of their choice regarding the appropriateness of investing/trading or of any particular investment/trading strategy.

Refund Policy. I acknowledge that any payment (including part payments) towards fees once paid is not refundable. The decision of the Money Secrets shall be final and binding.

Food & Refreshment Policy. I acknowledge and understand that Money Secrets are not responsible for providing me with food and refreshment during classes. I further acknowledge that it is my responsibility to make all arrangements concerning the same.

General Retake Policy.

Any class that I repeat must have been paid for in full. Money Secrets reserves the right to define “space available” and to substitute instructors at any time. I acknowledge that I am not permitted to enrol or participate in more than one retake class at a time.

Conditions. I acknowledge that I may not initiate recording(s) of any kind during any class or Lab, On-Location or online. I understand that Money Secrets may terminate my participation in the course or services (including Labs) at any time at its sole discretion. If Money Secrets makes such determination, it will promptly refund the proportional tuition fee, as determined by Money Secrets, that correlates with the untaken portion of the class or program. For online classes only: I must notify my Centre of my inability to attend a scheduled class no less than 4 days before the start date of the class otherwise I will forfeit my access to the Lab. Courses, programs, access to the Community and other services are non-transferable.

Trading Risk. I understand that neither Money Secrets, my participation in the Community or courses therein, nor any brokerage firm at which I open a trading account can or will assure me that my trading will result in profits. I understand that any capital I allocate to trading during or after taking this course or participating in this Community may be lost in its entirety. I understand that I will be taught how to invest or trade short term in some cases on an intra-day basis, use of trading software and the data it displays, but will not be given specific recommendations as to particular financial instruments to trade at particular times. All trading done by me during or after taking any course, Lab or Post Class Activity or otherwise participating in this Community will be determined by me alone and will be at my own risk.

Communications. I hereby opt into the use of my email address for both transactional and marketing materials and the use of my cell phone number for calls and texts. I expressly authorize Money Secrets to call me or send me recorded messages or texts about their products using automated technology to my telephone/cellular number. I understand that I am not required to give this consent to make a purchase. That this shall be applicable even if my number is registered under the DND.

Class Completion Requirements. I acknowledge (a) all classes must be taken at the selling location or online within 2 years after signing this Enrolment Agreement; (b) class fees are non-refundable, except as indicated herein; (c) classes must be chosen from the posted schedule and are subject to change. Availability is on a first-come/first-served basis. I acknowledge that my printed Enrolment Agreement contains the details of the course(s) I purchased.

Payments. Payment made by cheque will have to be in favour of Money Secrets IMF LLP

Limitation of Liability. I agree that how I use the goods and services provided to me under this Agreement and in the Community is at my own risk.

Indemnity. I agree to indemnify and hold harmless Money Secrets and their employees, directors, officers and representatives from all losses, claims, expenses and liabilities (including attorney-client expenses) directly on account of my failure or a breach in complying with any of the obligations set out herein whether arising under this Agreement or otherwise.

Intellectual Property I acknowledge that all information, whether in the form of presentations, software, notes, books, manuals, course materials, in any form, including the process followed in imparting training, methodologies and process used during the training program, and the student database, is the Intellectual Property of Money Secrets, and shall not be used, copied, recycled, re-engineered, or in any manner further used, whether in part or full without the prior written permission of Money Secrets. I shall be liable for legal action in case the intellectual property of Money Secrets is put to any further use without the prior written permission of Money Secrets.

DISPUTE RESOLUTION. Money Secrets wants me to be a happy lifelong member of the Community but if there’s an issue that needs to be resolved this section outlines what is expected of both of us.

GOOD FAITH NEGOTIATION. If there is any dispute, claim question or disagreement arising from this Agreement and my use of all or any part of the Community we both agree to use our best efforts to settle the dispute, claim, question or disagreement by consulting and negotiating in good faith and, recognizing each other’s interests, attempt to reach a just and equitable solution satisfactory to both parties. The consultation and negotiation may be face to face, by telephone or by a form: of video conference such as Zoom. If we do not reach a negotiated solution within 60 days, then any dispute or claim relating in any way to my use of all or any part of the Community will be resolved by binding arbitration, rather than in court, except that I may assert claims in small claims court if my claims qualify.

ARBITRATION – IF WE DO NOT RESOLVE ANY DISPUTE BY INFORMAL NEGOTIATION OR IN SMALL CLAIMS COURT, ANY OTHER EFFORT TO RESOLVE THE DISPUTE WILL BE CONDUCTED EXCLUSIVELY BY BINDING ARBITRATION

ARBITRATION. If we do not reach a negotiated solution within 60 days, then upon notice by either of us to the other all disputes, claim, questions or differences shall be finally settled by arbitration administered by the Arbitration & Conciliation Act 1996. The venue of the Arbitration shall be at Surat and the language of the arbitration shall be English. The cost of the Arbitration shall be borne by both parties.

I understand that I am giving up the right to litigate (or participate in as a party or class member) all disputes in court before a judge. Instead, all disputes will be resolved before an arbitrator, duly appointed by Money Secrets, whose decision will be final and binding, except for a limited right of appeal under the Arbitration & Conciliation Act 1996. Any court with jurisdiction over the parties may enforce the arbitrator’s award.

I understand that if negotiation has failed to resolve and if I wish to begin an arbitration proceeding. I may either send a letter requesting arbitration and describing the claim to the offices of Money Secrets

NO CLASS ACTIONS. We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. We also both agree that we may bring suit in court to enjoin infringement or another misuse of intellectual property rights.
